Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Partners in Par application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App, including free and paid subscribers.

2. Description of Service

Partners in Par is a lifestyle and golf companion app designed for couples and golf enthusiasts. The App provides features including golf round tracking, trip planning, AI-powered date and itinerary suggestions, community posts, learning modules, and challenges. Some features require a paid subscription.

3. Eligibility

You must be at least 13 years of age (or 16 in certain jurisdictions) to use the App. By using the App, you represent that you meet this requirement. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating an account.
• You may not share your account with others or create multiple accounts for the same individual.
• We reserve the right to terminate accounts that violate these Terms.

5. Subscriptions & Payments

• Some features of the App require a paid subscription (Monthly, Annual, or Lifetime).
• Subscription fees are billed in advance and are non-refundable except as required by applicable law.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your App Store account settings.
• We reserve the right to modify subscription pricing with reasonable advance notice.
• Payment processing is handled by Stripe and subject to Stripe's terms and privacy policy.

6. User-Generated Content

You retain ownership of content you create in the App (posts, memories, photos, notes). By posting content, you grant us a non-exclusive, royalty-free license to host and display that content within the App to provide the service.

You agree not to post content that:

• Is unlawful, harassing, defamatory, or discriminatory.
• Infringes on third-party intellectual property rights.
• Contains spam, malware, or deceptive content.
• Violates another person's privacy.

We reserve the right to remove content that violates these Terms without notice.

7. Artificial Intelligence Features

The App includes AI-powered features such as the Caddie Cupid assistant and itinerary planner. AI-generated content is provided for informational and entertainment purposes only. We make no warranties about the accuracy, reliability, or completeness of AI-generated suggestions. Golf course recommendations, booking links, and location information generated by AI should be independently verified before use.

8. Third-Party Integrations

The App may integrate with third-party services such as Google Calendar. Your use of such integrations is subject to the relevant third party's terms of service and privacy policy. We are not responsible for third-party services or content. You may revoke third-party integrations at any time in your account settings.

9. Intellectual Property

The App, including its design, text, graphics, logos, and software, is owned by Partners in Par and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PARTNERS IN PAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Arizona.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notification. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Copyright & DMCA Policy

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content available on or through the App infringes a copyright you own or control, you may submit a takedown request under the Digital Millennium Copyright Act (DMCA) by providing the following in writing:

• A physical or electronic signature of the copyright owner or an authorized agent.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing, including its location on the App.
• Your contact information, including full name, mailing address, telephone number, and email.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.

Send DMCA notices to support@partners-in-par.com with the subject line "DMCA Takedown Request." We will review and process valid notices in accordance with applicable law. Counter-notification procedures are available upon request.
